Bismillah

Asalaamu Alaikum wa Rahmatullahi wa Barakatu-

Alhamdullilah, the study sessions have been going well. We had a few questions however, if insha'Allah, someone can help us out.


Issue 9: Vessels and Utensils of non-Muslims
Question: We were all in agreement about the opinions, but we couldn't match up the opinions with the proofs. Also we were a bit confused with respect to the two Quranic proofs...surat al Ma'ida and surat at-Tawba

Issue 13: Man touching a woman or a woman touching a man
Question: Since we didn't have the Arabic text, it was harder to decipher which proof went with which opinion. Can someone clarify?

Issue 16: Is purification a condition for touching a Mushaf (copy of the Quran)
Question: What were the 3 opinions and by whom?

waalaikumussalaam, this is what i have in my notes regarding

Issue 9: Vessels and Utensils of non-Muslims


1st opinion permissible - hadith Imran ibn Hussain
2nd not prermissible unless no other choice - hadith Abu Tha'labah al khushani
3rd permissible from ahle kitaab -proof verse5:5, not permissible from polytheists - verse 9:28

Issue 13: Man touching a woman or a woman touching a man

1st opinion Imam Shafi'i proof verse 5:6
2nd opinion (stronger) abu Hanifah proof 2 hadiths by Aa'ishah
3rd opinion ahmed and malik hadith Urwah related that Aa'ishah.....


Issue 16: Is purification a condition for touching a Mushaf (copy of the Quran)

THERE ARE TWO OPINIONS
1.MAJORITY (MALIK, ABU HANIFA, AL SHAFI'I) PUIRFICATION IS A CONDITION FOR TOUCHING THE MUSHAF. their proof HADITH OF AMR IBN HAZM( where - taahir refers to mutwaDDA' and not muslim), AND THE VERSE 56:79, AND THE STATEMENT OF SAD IBN ABI WAQQAS ordering his son to make wudu to read the Quran.
2.THE DHAHIREES HELD THAT IT IS NOT A CONDITION because the verse "laa yamassuHU refers to LAWHUN MAHFUUZ and ALMATAHHAROON refers to angels (this is the correct interpretation of the verse) as there is no evidence in the Book or in the Sunnah (they reject the hadith of amr ibn hazm )the matter is to be left to the original rule of nonliability, which is permissible.
SUMMARY - BETTER TO HAVE WUDU TO TOUCH THE MUSHAF BUT NOT A SIN IF ONE TOUCHES WITHOUT IT.
