What is the source?

Assalamu Alaikum,

Shaikh Abdulbary mentioned in the class that when there is contradiction in two virtues, the one related to the salah takes precedence. Is it ijma of the scholars? Can anyone please mention the name of a book which discusses this fiqh rule ?

Jazakallah Khair.

AssalamuAlaikum,

Are you talking about when there is a choice (not contradiction) between two virtues (meaning you can only do one at the moment or have no time to do both), which one do you choose?

For example, when choosing between reading Tahyaatul Masjid upon entering the Masjid or joining the congregation in their Fard prayer--one would chose the congregation because it was directly related to the fard prayer itself (and not an extra, encouraged action such as tahyaatul masjid when compared to the Fard salaah).

The precedence goes to the action which is directly related to the fard action, and only then can other actions be taken.

Is this what you are talking about? Hope this helps.

Assalaamu Alaikum,

Jazakallah khair sister. I wanted to know whether there is any hadith related to it or it is based on reasoning. From your answer, I understand that this rule is based on reasoning.

Wassalaam.

I suppose you are right, but doesn't the very definition of "fard" as opposed to "mustahaab" make this issue pretty much common sense? (as to which action takes precedence)? Maybe that's why there was no "proof" given in the class...?

Re: What is the source?

Assalamu 'alaikum,

so the Shaikh said that when it comes to virtues related to outside of the Salaah (Wudoo') vs. virtues within the Salaah (khushoo and time spent praying), the virtues inside the Salaah take precedence.

So if 'Iqaamah is called and u still have to make Wudoo', you do the Fardh Wudoo' (washing everything once instead of 3 times) to catch the prayer, which has more rewards vs. the Wudoo'.

As Sumiyyah said, this is just based on common sense because Wudoo's rewards are not greater than the rewards of Salaah.

WAllahu 'Alem
