capital punishment is an option given to the family of the victim not the judge...If even one immediate relative opposes death penalty, it is not given.

I thought it was really interesting to see how the time each A'lim lived in would affect the outcome of his books, for example, Imam Al-Ghazali, who was the first to incorporate kalaam, logic and philosophy into Usool Al-fiqh, and who defended his own methodology and incorporation of the 'Aql (mind) into his works, lived in a time period where the factors affecting fiqh included:

- the promotion of individual mathaahib
- Hypothetical fiqh – many scholars wanted to keep fiqh alive and dynamic rather than keeping it stagnant – introduced principles of Al-Ashbaah wan-Nathaa2ir (similarities and parallel situations)
- The ulama started confining themselves to their school of thoughts
- Evolution of the classical and traditional format of writing books of fiqh

I would assume that these factors would have affected the writings of Imam Ghazali somehow, and it would kinda make sense, considering his work... ??? Allahu A'lam, I don't know anything about the topic really, but I wanted to correlate...

About Imam Shafi'ee -- even is after his life if a hadeeth was found to be authentic he would have accepted it.

piracy started as a revolutionary movement to free people who were being held against their will in societies that oppressed them as a minority. (ummm... yeah my take on piracy)

if you drink from the tigris (i think that was the river, right?).... it's drinking the work of the great scholars... except... not as healthy as just reading the books
